Separate the application file from property due diligence

The residence-permit checklist and the property-purchase review are related but not identical. The official procedure lists identity, entry status, insurance, fees and property evidence for the application. Independent due diligence must also test title, encumbrances, planning status, building acts, cadastral records and contract protections.

A complete process keeps both workstreams visible. A document accepted for one purpose may not answer every ownership or construction risk.

Core ownership and notarial evidence

The file should include the transfer deed, proof of registration, the precise property description and a notarial certificate covering the contracting parties, agreed price, payment method, completion of payment and any resolutory condition. The notary also addresses whether the property has previously been used by the seller for a Golden Visa issuance where the procedure requires that confirmation.

Names, tax numbers, property identifiers and amounts must remain consistent across every document and payment record.

What the engineer should confirm

The engineer should identify the legal act supporting the change of use and confirm that the main spaces have been converted to residential use. The review should explain the relevant permit, approval, update or revision and the date on which the qualifying change was completed.

The buyer should also request the drawings, current layout, any legalization or regularisation material, the building identity where applicable and evidence for any industrial non-use condition. The engineer should report exceptions, assumptions and missing material in writing.

Red flags that require resolution

  • Different property descriptions across the deed, plans and cadastral record.
  • A marketing plan that does not match the approved or as-built layout.
  • A conversion date that cannot be supported by the technical file.
  • Payment instructions that differ from the notarial structure.
  • Unresolved liens, ownership gaps or prior Golden Visa use.
  • Statements of eligibility without a property-specific written review.

A practical review sequence

Start with a document index. The lawyer reviews title and transaction structure; the engineer reviews planning and physical status; the notary aligns deed and payment evidence; the immigration professional checks the residence-permit file. Questions should be resolved before an unconditional reservation or final payment.
