How this route differs from standard residential thresholds

The lower threshold does not remove legal, engineering, notarial or payment checks.
A buyer should therefore ask, “Why does this exact property qualify?” rather than relying on its advertised price. The answer should be supported by the title, cadastral records, prior-use evidence, conversion documentation, engineer’s report and proposed contract.
Property test 1: one property and full ownership
The official change-of-use procedure identifies a minimum acquisition value of EUR 250,000 and refers to full ownership and possession of one property. It does not apply a 120-square-metre minimum to this special route. Transaction structures should be reviewed before reservation, particularly where marketing material refers to multiple units, ancillary areas, shares or rights that may not correspond to one qualifying property.
The lawyer and notary should confirm the legal identity of the asset, the seller’s title, encumbrances, registration position and the way the property will be described in the contract. The engineer should confirm that the same asset is covered by the technical material.
Property test 2: prior use and completed conversion
The special category requires evidence of the qualifying prior use and lawful conversion to residential use. The current official procedure states that the change of use must have taken place after 5 April 2024 and must be completed before the Golden Visa application is submitted. It also explains how an older permit may be considered when it was revised or updated after the law took effect. This is a technical legal question for the specific file.
The conversion should not be treated as complete merely because renovation work has begun or a future apartment layout is shown. Advisers should review the permit history, approved plans, completion evidence and engineer’s technical report. The physical unit, title and application documents need to describe the same property consistently.
Property test 3: industrial-building history where relevant
Where the asset is an industrial building, the official procedure requires that no industrial activity has operated there during the previous five years. Evidence and interpretation will depend on the property history. A general statement in a brochure is not enough; the independent professional team should identify the documents supporting this condition.
Payment test: full and traceable consideration
The official process requires full payment of the acquisition price using permitted traceable methods. The notarial documentation must address payment, and the application file must be consistent with the contract and bank evidence. The official page also notes circumstances in which payment may be made by a spouse or relatives up to the second degree, but the exact structure should be approved by the lawyer and notary before funds move.
Keep bank instructions, transfer confirmations, account records and the final notarial statement. Do not split or label payments informally without professional review. Currency conversion, bank charges and timing can affect the visible payment trail even when the commercial price is clear.
Document test: build one consistent file
The official list includes the application materials, passport and lawful-entry evidence, insurance, the property contract, proof of registration or cadastral filing, notarial certification and an engineer’s technical report. Additional documents may be required by the facts of the applicant, family or property. Translations, apostilles or legalisation should be planned with the adviser responsible for the application.
Consistency is essential. The applicant name, property identifiers, price, dates and payment details should align across the contract, certificates, technical report and application. A late discrepancy can delay clarification even when the underlying project is sound.
Application timing and official fees
The Mitos procedure describes a five-year residence permit, digital submission and official administrative fees of EUR 2,000 plus EUR 16 for the card. Other transaction and professional costs are separate. The page gives a 50-day administrative deadline, but this should be understood as an official procedural benchmark, not a guaranteed completion date. Actual timing can depend on appointment capacity, file completeness, requests for clarification and authority workload.
Rights and restrictions require separate advice
The official procedure states that this permit does not provide access to employment. Residence rights, family inclusion, travel, renewal, property use and rental restrictions should each be explained under the current rules. A Golden Visa does not make every use of the property unrestricted, and future policy continuity should never be promised.
